## Summary

On or about August 15, 2018, U.S. District Court Judge Norman Moon entered the above captioned Ability-to-Pay Consent Decree (ï¿½ATP CDï¿½) in conjunction with the corresponding civil complaint, for the Buckingham County Landfill Superfund Site, located in Dillwyn, Buckingham County Virginia (ï¿½Siteï¿½).  The ATP CD and Complaint were lodged with the United States District Court for the Western District of Virginia (Lynchburg division), and did not receive any public comment(s).  Under the proposed ATP CD, Defendant Buckingham County has agreed to reimburse $125,000 towards the United Statesï¿½ past and future response costs at the Site, which are currently in excess of $4,499,269.70.  In return, the County will receive a comprehensive covenant not to sue with respect to the United Statesï¿½ past and future unreimbursed response costs.  The payment shall be made within 30 days of entry, with the monies to be deposited to the Siteï¿½s Special Account.
