This is a Civil Judicial Referral pursuant to CERCLA sections 106 and 107 asking the Department of Justice to bring an action against Unidynamics-Phoenix, Inc. and its parent corporation, Crane Company. The Referral involves a request for a declaratory judgment on liability, injunctive relief, cost recovery and punitive damages for failure to comply with EPA-issued orders to conduct remedial action at an NPL Site. The Referral requests filing of a complaint requesting an order directing Defendants to implement the SVE system at the Site, reimburse EPA for costs incurred implementing the SVE system, and requiring payment of daily damages and treble damages for the period Defendants refused to comply with EPA's Orders.
