## Abstract

This rule establishes water quality standards applicable to waters of the United States in the State of Arizona. EPA is promulgating this rule pursuant to a court order in Defenders of Wildlife v. Browner (Docket No. Civ. 93-234 TUC ACM). The rule designates fish consumption as a use for certain waters, and requires implementation of a monitoring program regarding mercury's effects on wildlife. On January 29, 1996, EPA published a proposed rule that included other provisions which are not being promulgated as part of today's rule because, after EPA's proposal, the Arizona Department of Environmental Quality adopted revised regulations and policies in those areas which EPA Region 9 has determined are in accordance with the Clean Water Act.
