## Abstract

EPA is promulgating water quality standards applicable to the waters of the United States in the State of Idaho. These standards supersede certain aspects of Idaho's water quality standards that EPA disapproved in 1996. EPA disapproved those standards after concluding they were inconsistent with the Clean Water Act and EPA's implementing regulations. The proposal to this rulemaking was published in the Federal Register on April 28, 1997. EPA is promulgating new use designations for 5 specified waterbodies in the state of Idaho, as well as a variance procedure that may be used to obtain relief from those use designations. Today's rule also establishes temperature criteria applicable to bull trout spawning and rearing in specified waterbodies. Finally, EPA is promulgating a federal rule to supersede the state's excluded waters provision. EPA is not promulgating certain other aspects of the proposed rule, due either to further analysis by EPA or to state action which addressed these issues.
