Abstract

The Audio Division, at the request of Charles Crawford, allots Channel 232A at Cove, Arkansas, as the community's first local aural transmission service. See 68 FR 42663, July 18, 2003. Channel 232A can be allotted to Cove in compliance with the Commission's minimum distance separation requirements with a site restriction of 14.9 kilometers (9.2 miles) southwest to avoid a short-spacing to the license site of Station KOLX, Channel 233C2, Barling, AR. The reference coordinates for Channel 232A at Cove are 34-22-17 North Latitude and 94-33-12 West Longitude. The Audio Division, at the request of Katherine Pyeatt, allots Channel 289A at Robert Lee, Texas, as the community's first local aural transmission service. See 68 FR 42663, July 18, 2003. Channel 289A can be allotted to Robert Lee in compliance with the Commission's minimum distance separation requirements, provided there is a site restriction of 14.3 kilometers (8.9 miles) north to avoid a short-spacing to the vacant allotment site of Channel 289C1, Ozona, Texas. The reference coordinates for Channel 289A at Robert Lee are 32-00-56 North Latitude and 100-26-20 West Longitude. Although concurrence has been requested for Channel 289A at Robert Lee, notification has not been received. If a construction permit is granted prior to the receipt of formal concurrence in the allotment by the Mexican government, the construction permit will include the following condition: "Use of this allotment is subject to suspension, modification, or termination without right to hearing, if found by the Commission to be necessary in order to conform to the 1992 USA-Mexico FM Broadcast Agreement or if specifically objected to by Mexico's Secretaria de Comunicaciones Y Transportes." Filing windows for Channel 232A at Cove, Arkansas and Channel 289A at Robert Lee, Texas will not be opened at this time. Instead, the issue of opening a filing window for these channels will be addressed by the Commission in a subsequent order.
