Abstract

The Commission, at the request of N'Joy Broadcasting, allots Channel 249A to Raton, NM, as the community's third local FM service. The petitioner can also amend its pending application (BPH-960124MA) to specify operation on Channel 249A in lieu of Channel 243A and retain cut-off protection. See 61 FR 55125, October 25, 1996. Channel 249A can be allotted to Raton in compliance with the Commission's minimum distance separation requirements at the transmitter site specified in petitioner's pending application, which is 6.3 kilometers (3.9 miles) north of the community, at coordinates 36-57-18 North Latitude and 104- 25-22 West Longitude. The Commission did not allot Channel 299A to Raton, which was proposed to accommodate other parties expressing an intention to apply for the channel, because no such expressions of interest were received. With this action, this proceeding is terminated.
