Section 1006(e)(1) of the Oil Pollution Act of 1990 requires the President, acting through the Under Secretary of Commerce for Oceans and Atmosphere, to promulgate regulations for the assessments of natural resource damages resulting from the discharge of oil. The National Oceanic and Atmospheric Administration (NOAA) promulgated final regulations on January 5, 1996. As part of the development of the regulations, NOAA has developed five natural resource damage assessment guidance documents. These documents are not regulatory in nature, but are designed to provide guidance to natural resource trustees using the natural resource damage assessment regulations.
