Abstract

In this document, the Federal Trade Commission ("FTC" or "Commission"), pursuant to a directive in the Consolidated Appropriations Act of 2004, issues its Statement of Basis and Purpose ("SBP") and final amended Telemarketing Sales Rule ("TSR" or "Rule") Section 310.4(b)(3)(iv). This amended section of the TSR now requires sellers and telemarketers, in complying with the do-not-call provisions of the TSR, to use a version of the National Do Not Call Registry obtained from the Commission no more than thirty-one (31) days prior to the date any call is made, rather than three (3) months prior to the date any call is made, as is allowed under the current TSR.
