This report is being filed under protest and solely to abate citation 7165720. According to MSHA, employee incurred a reportable injury when he struck himself in the mouth with a slate bar resulting in a broken tooth. Brody denies that it breached and duty to report an occupational injury and reserves the right to contest the issuance of the citation.
