On February 28, 2006, a Notice of Violation and Exercise of Enforcement Discretion was issued for a Severity Level III violation involving the failure to obtain an exempt distribution license, as required by 10 CFR 30.15, prior to transferring specialty light bulbs containing radioactive material (Kr-85). Based on the facts that Star-Lite Global stopped importing and distributing the Kr-85 bulbs by the fall of 2003, no longer operates or conducts transactions, plans to file for bankruptcy, and the low safety significance of the Kr-85 bulbs that it distributed, the NRC is exercising discretion to refrain from issuing a civil penalty in this case.
