On October 12, 2007, a Severity Level III Notice of Violation and Exercise of Enforcement Discretion were issued to South Carolina Electric and Gas Company (SCE&G). The violation resulted from changes the licensee made to its Emergency Plan between October 1980 and July 2006. Contrary to 10 CFR 50.54(q) which allows a licensee to make changes to emergency plans without Commission approval when such changes do not decrease the effectiveness of the plans and the plans, as changed, continue to meet the standards of 10 CFR 50.47(b), SCE&G made changes without Commission approval which decreased the effectiveness of their Emergency Plan and resulted in the use of a non-standard scheme of Emergency Action levels.
