PE&H INVESTMENTS (TXU010444): A storm water compliance inspection was conducted by EPA at the commercial construction site of the Mazda of Midland on March 16, 2004, to determine the compliance status of PE&H Investments. It was determined that, as an operator, PE&H Investments was not in compliance with the Storm Water Construction General Permit in that they had not developed a Storm Water Pollution Prevention Plan (SWPPP) not had they applied for permit coverage. As they met the criteria for an Expedited Settlement Offer (ESO), one was extended and accepted for a penalty amount of $6300.00.
