EPA Region 8 filed an Administrative Order on Consent (Consent Order) with Vac-U-Jet Septic and Sump Service, Inc. (Vac-U-Jet) under section 309 of the Clean Water Act for illegally land applying domestic septage in western North Dakota. This Order was based on Vac-U-JetÂs response to a Clean Water Act information request indicating that Vac-U-Jet was not complying with the domestic septage land application requirements. The Consent Order requires that Vac-U-Jet cease all application of domestic septage to land unless the application complies with the requirements set forth in the EPAÂs domestic septage regulations, including application rate and pathogen and vector attraction reduction. Vac-U-Jet is required to submit four consecutive quarterly reports to the EPA detailing the method and manner of all land application of domestic septage in accordance with the regulations. Region 8 will consider closing the Consent Order after 12 months, depending on Vac-U-JetÂs compliance with the Consent Order and underlying regulations. NPDES Enforcement has coordinated closely with the North Dakota Department of Health on this matter.
