The Order requires the Respondents complete the remedial action at the NL Industries Superfund Site, located on Pennsgrove-Pedricktown Road in Pedricktown, Salem County, New Jersey. NL Industries, Inc. is liable under Section 107(a)(2) of CERCLA as an owner and operator of the Site at the time hazardous substances were disposed of. The remaining Respondents are liable under Section 107(a)(3) of CERCLA as ?generators? since their hazardous substances were transported to and later disposed of at the Site. The OU1 ROD Amendment also required that the original groundwater remedy, as described in the OU1 ROD, be retained as a contingent remedy to be used if the amended remedy failed to achieve Site remediation standards.
