On May 1, 2013, Kinder Morgan Energy Partners LP (Kinder Morgan) acquired Copano Energy LLC and its affiliates (Copano), and entered into an Audit Agreement under EPA?s policy entitled Incentives for Self-Policing: Discovery, Disclosure, Correction and Prevention of Violations, 65 Fed. Reg. 19,618 (April 11, 2000) (Audit Policy) and the Interim Approach to Applying the Audit Policy to New Owners, 73 Fed. Reg. 44991 (August 1, 2008) (Interim Approach)
Kinder Morgan?s disclosures included potential violations of Section 112(r) of the Clean Air Act (CAA), 42 U.S.C. ? 7412(r), and 40 C.F.R. Part 68, and have resulted in a final list of 211 CAA RMP violations, which are the subject of this resolution.
