On July 29, 2019, Karl and David Lamb (Respondents') used a track hoe to excavate materials from the Duchesne River and floodplain, as well as to partially construct a diversion channel that ran onto the neighboring parcel held in trust for the Ute Indian Tribe. Respondents' activities were undertaken without a permit from the U.S. Army Corps of Engineers.
