Respondent did not meet coal combustion residual (CCR) regulation requirements in 40 CFR 257. Specifically, the facility failed to install an adequate groundwater monitoring system; failed to develop and submit annual groundwater monitoring and corrective action reports; failed to statistical analysis and establish background; failed to conduct semi-annual monitoring; exceeded the cease-receipt date for non-compliant surface impoundment; failed to post on information on public website, maintain information in facility operating record, and failed to provided notifications to state. The Consent Agreement included payment of a penalty on 6/16/22 and implementation of measures to return the facility to compliance with the CCR regulations.
