On January 3, 2023, EPA Region 10 filed an expedited settlement agreement resolving violations of the 2017 Construction General Permit by M3 ID Rising Sun LLC, Conger Management Group, Inc., and Syman LLC at the Rising Sun subdivision construction site in Kuna, Idaho. Alleged violations included unpermitted discharges, inadequate Best Management Practice (BMP) maintenance and control measures, missed inspections, and Stormwater Pollution Prevention Plan (SWPPP) deficiencies. This enforcement action stands to prevent the discharge of more than 13 tons of sediment into Indian Creek and New York Canal. The Respondents have agreed to pay a penalty of $15,240 and have returned to compliance. The estimated cost of injunctive relief is $3,500.
