On July 9, 2024, Region 3 issued an Expedited Settlement Agreement and Final Order (ESA) that commenced and concluded a matter against Dutchland, Inc. ( Dutchland ). Dutchland is a concrete manufacturer located at 160 PA-41, Gap, Pennsylvania 17524. The cited violation is discharging without an NPDES permit. The ESA settles the violations with a civil penalty of $40,000. The ESA was subject to public comment, which ended on June 21, 2024 with no comments received. The Facility is not in an area of EJ concern. None of the supplemental EJ Indexes are at-or-above the 90th percentile in the nation or in the state for the area. EPA has consulted with Pennsylvania Department of Environmental Protection during the development of this action.
