The Regional Administrator signed a Consent Order with Dr. Paul G. Modie and Dr. Robert F. Gustke ( Respondents ) regarding the Joyce National Power Superfund ( Site ) located in Eldred Township, McKean County, Pennsylvania. The Site had been contaminated with nitroglycerin and dinitrotoluene from explosive manufacturing activities formerly conducted on the property. The Respondents will pay a combined total of $190,000 and received a covenant not to sue for present and future liabilities. The settlement amount was determined based upon litigation risks and inability to pay considerations. This recovery will abate the costs EPA incurred at the Site and will be used to further EPA's enforcement efforts at other Sites.
