The Respondent operates an oil production facility located in the Northeast Quarter of Section 36, Township 27 North, Range 13 East, Washington County, Oklahoma. On September 20,2002, EPA documented an unauthorized discharge of pollutants, specifically produced waters (brine), to a tributary of Coon Creek from the facility(tank battery)in violation of Section 301 of the Clean Water Act. A settlement agreement was offered to the Respondent on October 2,2002 to allow mitigration of the proposed penalty amount. The deadline for completion of the tasks agreed upon by the Respondent in the settlement agreement is November 22, 2002. An administrative penalty order was proposed on 1/6/03 to require the Respondent to pay a penalty amount for the discharge of pollutants to waters of the United States.
