The EPA is providing direct final approval of the New Mexico State Implementation Plan (SIP) for the Dona Ana County ozone nonattainment area. The area was designated nonattainment for ozone and classified as "marginal" in 1995. New Mexico submitted its SIP for the Dona Ana County area in 1997, requesting approval of the SIP, and requesting approval of a waiver of nitrogen oxides (NO<INF>X</INF>) requirements contained in section 182(f) of the Clean Air Act, as amended in 1990 (the Act). With this action the EPA is providing direct final approval of the Dona Ana County nonattainment area SIP and waiver of NO<INF>X</INF> requirements. The waiver for NO<INF>X</INF> requirements is granted because the area has attained the one-hour ozone standard without them, within the deadline prescribed by the Act.
