Abstract

EPA is taking direct final action to approve the hospital/ medical/ infectious incinerator (HMIWI) section 111(d)/129 plan (the "plan") submitted to EPA on August 25, 2003 by the Virginia Department of Environmental Quality (DEQ). The plan includes supplemental information submitted on August 11, 2003, and April 6, and July 23, 2004. The plan establishes emission limits, monitoring, operating, and recordkeeping requirements for commercial and industrial solid waste incinerator units for which construction commenced on or before November 30, 1999. Submittal and approval of the plan fulfills a Clean Air Act (the Act) requirement for the Commonwealth of Virginia. As a result, the Federal plan (65 FR 49868, August 15, 2000) is no longer applicable, as of the effective date of this action.
