The Environmental Protection Agency (EPA or Agency) today is granting a petition submitted by Bethlehem Steel Corporation (``BSC''), Lackawanna, New York, to exclude (or ``delist''), on a one-time basis, certain solid wastes contained in a landfill from being listed hazardous wastes. This action responds to BSC's petition to delist these wastes on a ``generator-specific'' basis from the hazardous waste lists. Based on careful analyses of the waste-specific information provided by the petitioner, the Agency has concluded that BSC's petitioned waste will not adversely affect human health and the environment. Accordingly, this final rule excludes the petitioned waste from the requirements of hazardous waste regulations under Subtitle C of the Resource Conservation and Recovery Act (RCRA).
