Abstract

The EPA is promulgating a direct final rule conditionally exempting the Territory of American Samoa (American Samoa), the Commonwealth of the Northern Mariana Islands (CNMI), and the Territory of Guam (Guam), as well as certain owners and operators of sources in American Samoa, CNMI and Guam from the requirements of title V of the Clean Air Act (Act). EPA is revising its September 13, 1995 proposed rule with respect to Guam. In the proposed action, EPA granted American Samoa and CNMI, as well as owners and operators of certain sources within those territories, a conditional exemption from title V requirements. In the proposal, EPA also granted Guam an extension of time in which to adopt a title V permit program and owners or operators of certain sources an extension of time in which to obtain title V permits. EPA has revised the proposal and today is promulgating a direct final rule that maintains the conditional exemptions granted to American Samoa and CNMI and also conditionally exempts Guam from title V of the Clean Air Act. EPA is granting these conditional exemptions under the authority of section 325 of the Act.
