On December 6, 1994, EPA proposed to allow the import and export of Polychlorinated Biphenyls (PCBs) for disposal at concentrations of 50 parts per million (ppm) or greater under certain circumstances. This final rule promulgates regulations at 40 CFR part 761, subpart F to permit the import of PCBs for disposal at concentrations of 50 ppm or greater. Today's rule continues to allow the import and export of PCBs for disposal at concentrations less than 50 ppm. Those portions of the December 6, 1994, proposed rule addressing other issues, including export of PCBs for disposal at concentrations of 50 ppm or greater and other transboundary shipments of PCB waste, will be addressed in a separate Federal Register notice at a later date. This rule will provide for the sensible management of PCB waste imports, consistent with hazardous waste import regulations, and the United States' obligations under international agreements. This rule will benefit the United States by facilitating the safe removal of PCBs from areas near the United States' borders, as well as the world environment in general, and this rule will produce economic benefits for the United States.
