The Environmental Protection Agency (EPA) today is granting a petition submitted by American Steel Cord, formerly Kokoku Steel Cord Corporation, to exclude (or ``delist'') certain solid wastes from the lists of hazardous wastes contained in Title 40 of the Code of Federal Regulations, Subpart D of Part 261. EPA has concluded that the petitioned waste is not a hazardous waste when disposed of in a Subtitle D landfill. This exclusion applies only to the wastewater treatment plant (WWTP) sludge generated by American Steel Cord in Scottsburg, Indiana. Today's action conditionally excludes the petitioned waste from the requirements of the hazardous waste regulations under the Resource Conservation and Recovery Act (RCRA) when disposed of in a Subtitle D landfill.
