The contact owned a 2024 Hyundai Elantra. The contact stated that while stopped in traffic on a three-lane highway, another vehicle with a distracted driver crashed into the rear driverâs side and side-swiped the vehicle up to the front driverâs side door of the contactâs vehicle at approximately 50 MPH and pushed the contactâs vehicle into rear-end of the vehicle in front, causing that vehicle to spin around on the highway. The vehicles came to a stop after the impact. The contact stated that the air bags failed to deploy. Additionally, the Blue Link Service in the vehicle failed to activate to notify the Emergency Services of the crash. No warning lights were illuminated. The vehicle was towed to the local Caliber Collision body shop. The contact stated that the vehicle was deemed a total loss by the body shop and the Insurance provider. A Police report was filed. The contact sustained injuries to her neck, back, a torn left rotator cuff, and injuries to her shoulders. Medical attention was sought for the injuries sustained. The contact was receiving physical therapy and pain management for the injuries. The contact stated that there were no injuries to the other drivers. The local dealer was contacted; however, the vehicle was not diagnosed as it had been declared a total loss. The manufacturer was notified of the failure and informed the contact that there was no fault with the air bags or the Blue Link Service. The approximate failure mileage was 5,308.
